- ACCEPTANCE OF GENERAL CONDITIONS OF SALE Please read carefully these terms and conditions before placing any order. The products bearing the trademark MAGILU INTERNATIONAL SRL, registered in the Register of Companies of Verona, C.F. E P.I. 01957900234, located in Belfiore (VR) Via Strà n. 61. The purchase operations are regulated by the provisions of Legislative Decree n. 206 of 06/09/2005 (Consumer Code), the following terms are defined as follows: a) “online sales contract”: distant contract, e.g. the legal transaction having as its object movable properties and/or services entered into by a professional, in the present case Magilu International Srl, via our online service www.magilu.it, and a customer, in the context of an Internet distance selling system organized by the trader, who for that contract uses exclusively the distance communication technology denominated Internet; b) “professional”: the individual or legal entity acting within the course of its own business or through an intermediary; c) “customer”: an adult who is acting for purposes which are outside his business or profession. Magilu International shall modify or update anytime, in whole or in part, these General Conditions of Sale. Any changes or updates will be binding upon publication on the website and therefore every customer should read these pages periodically.
The private or professional customer, by sending the order confirmation electronically, and it being received, the contract is considered to be concluded.
The private or professional customer, with the transmission of the order confirmation, unconditionally accepts and agrees to observe in its relations with Magilu International, the General Sales Conditions, as well as the payment conditions indicated below, declaring to have read and accepted all the indications provided.
The present conditions can be printed or saved on a durable medium, in compliance with the provisions of article 12 of the Legislative Decree 206/2005, as modified by the Legislative Decree 21/2014.
- LINKS TO THE WEBSITE
Anyone who might be interested to activate a link to the homepage and other pages of the webpage of Magilu, is requested to submit consent from MAGILU INTERNATIONAL to the following e-mail address info@magilu.it.
Magilu International has the right to object to the activation of direct links to its own webpage in case the requester does not comply with our company policy.
Following the formal approval of the creation of links to our webpage, Magilu International assumes no responsibility for the services offered by third parties, regardless of the link to our website.
Any link attached by third parties to our webpage shall not cause any damage to the activity or image of Magilu International.
- SELLING PRICES ANS PURCHASE METHODS
The products offered for sale by Magilu International are uniquely the ones available on www.magilushop.it at the moment of the order forwarding, as described in the respective information document.
It is in any case understood that the images in support of the description document of a product are solely for information purposes and might not be representative of its characteristics but, for example, differ for color or dimensions (also because of the browser and monitor used to access the webpage and the pictures display).
To place an order, the customer shall fill in the respective form available on the website in its entirety and send the same after having carefully read the conditions and the characteristics of the product and/or of the products that the customer intends to purchase.
The correct reception of the order is confirmed by Magilu International via e-mail, sent to the customer’s e-mail address given by the same.
This confirmation message will report synthetically the purchase conditions, as established by the applicable regulation, and the data entered in the order by the customer, in order to be verified by the same, allowing the customer to report without delay the necessary corrections of wrong data.
All selling prices of the products displayed and indicated on the website www.magilushop.it are offered to the public pursuant to art. 1336 of the Civil Code and are in Euro and include VAT and other taxes related to sales in the EU.
For destinations outside of the EU any import duties, customs clearance fees and any other additional expenses will be charged to the customer. Therefore we recommend to enquire with the customs authorities about all the additional costs before completing the purchase.
The customer can pay for the goods using the payment methods indicated online at the time of purchase (credit card, bank transfer,…).
The prices are subject to updates. We recommend every customer to make sure of the selling price before forwarding the respective order.
- DELIVERY
Magilu International will take care of delivering the package to the trusted courier with the selected and ordered products, in order to be delivered to the customer at the indicated address.
Magilu International will do its utmost to fulfill the placed orders within 5 working days, from the reception to the payment.
Deliveries on the national territory might vary from 1 to 2 working days, while for the rest of Europe the wait is on average 7 days.
No liability can be ascribed to Magilu International for delayed or non-delivery due to force majeure or fortuitous events.
The delivery time may be longer in case of orders forwarded in the weekend or on public holidays.
In case of orders placed in the weekend, the same will be fulfilled the following Monday, while in case of orders placed on public holidays or during holiday closure, the processing will take place on the following first working day.
If the content of the shipment is returned for non-delivery, Magilu International will communicate to the customer the methods and the additional amount to pay to reattempt the delivery.
The goods will be shipped at the time of the reception of the payment, which shall be made within 15 days from the notification.
After this time the goods and the payments will be withheld by Magilu International under the form of reimbursement.
The customer and/or the person in charge of collecting the goods is required to check, at the moment of the delivery and in the presence of the carrier, the integrity and the number of the packages delivered, reporting any discrepancies to our customer service within 3 days from the reception of the goods. The seller reserves the right to not accept the order. - RIGHT OF WITHDRAWAL AND COMPLAINTS
In accordance with art. 64 of Legislative Decree 206/05 the customer can exercise the right of withdrawal and return the product received, in accordance with the following terms and methods.
The customer, that for any reason is not pleased with the purchase, has the right to withdraw from the contract within 14 days from the date of the invoice with the following procedure:
notify in writing to info@magilu.it the request of cancellation of the order, indicating the number of the order, the description of the items to be returned and the reason of the return;
make sure that the products to be returned have not been used, washed, damaged or anyway modified in their characteristics. Returns on tailored items and on customized products are not accepted (embroideries with company’s logos, names, etc);
return the products intact in their original packaging;
in case of returns, that are part of the same order, these need to be returned in one shipping;
the products need to be returned within 14 working days from the date of reception to: Magilu International SRL Via argine Maronari n. 16F – 37050 Belfiore (VR);
the return of the goods needs to be insured and happen via courier, considering that Magilu International will not accept liabilities for non-delivered or damaged in transit packages. The number of the order needs to be indicated in the transport document. For the reception the signature on the delivery note shall prevail;
the costs for the return are charged to the customer.
In case all the aforementioned conditions and obligations of the customer are complied with, Magilu International will arrange the refund of the selling price of the item purchased by crediting it directly on the credit card used for the payment or by bank transfer within 30 working days.
If not every one of the aforementioned conditions and terms are complied with, the customer will not have a right to be refunded. In this case Magilu International will request from the customer to arrange the collection of the goods via courier, in the conditions in which they were returned, to:

If the goods will not be collected within 30 days from the date of notification, Magilu International SRL reserves the right to retain the products as well as the sums already paid for the purchase, as a refund for the costs incurred as a result of the return procedure.
Customs duties and sales taxes are not refundable by Magilu International. The customer can recover these amounts by addressing to the customs office of competence.
- DATA PROCESSING
The provided data is collected, registered and used exclusively for activities functional to the completion and execution of the supply contractual relationship with you, including the activities arranged by us for the contact, the placement, the processing and the fulfillment of the orders, the formalization, the administration and the control of the relationship with the customers.

The General Sale Terms are regulated by the Italian Law and in particular by the Legislative Decree 06.09.2005 n. 206, in the Consumer Code, with a specific referral to the legislation with regard to distance contracts and by the Legislative Decree 9.04.2003 n. 70 about certain aspects regarding the electronic commerce.
